Types of correctional institutions

Correctional institutions are correctional colonies, educational colonies, prisons, medical correctional institutions. Investigatory isolators carry out the functions of correctional institutions in relation to those sentenced to deprivation of liberty who were left in the investigative isolators for the performance of work on economic services.

Convicts who have reached the age of eighteen serve their sentence of imprisonment in correctional colonies, which are subdivided into:

1) penal colony settlements;

2) correctional colonies for first-time prisoners;

3) correctional colonies for persons who have previously served a sentence of imprisonment;

4) correctional colony special treatment.

Terms of sending convicts to imprisonment to serve their sentences.

Those sentenced to imprisonment are sent to serve their sentences in correctional institutions not later than ten days from the date of receipt by the administration of the detention center of the notice of the entry into force of the court sentence. The procedure for sending convicts to correctional institutions is determined by the Ministry of Internal Affairs of the Republic of Belarus.

The procedure for the distribution of persons sentenced to imprisonment in correctional institutions.

Those sentenced to deprivation of liberty are sent to correctional institutions with due regard for the conditions necessary for their correction, maintaining useful social ties with relatives, ensuring security and preventing their commission of crimes.

Reasons for transfer of persons sentenced to deprivation of liberty to another PS of the same type.

Those sentenced to deprivation of liberty must serve the entire sentence, as a rule, in one correctional colony, prison or educational colony.

Transfer of a convict for further serving of a sentence from one correctional colony to another of the same type or from one prison to another is allowed in case of illness of the convicted person, upon reorganization or liquidation of the correctional institution, for receiving convicted education, as well as in exceptional circumstances preventing the convicted person from further this correctional institution. The transfer of convicts is determined by the Ministry of Internal Affairs of the Republic of Belarus.

The procedure for the distribution of prisoners to imprisonment in open correctional institutions.

Persons sentenced to restriction of liberty with a referral to an open-type correctional institution serve their sentence in open-type correctional institutions, subject to the conditions necessary for their correction, ensuring security and preventing their commission of crimes. The procedure for organizing the work of open correctional institutions is determined by the Ministry of Internal Affairs of the Republic of Belarus.

According to part 2.1 of art. 44 of the Penitentiary Code of the Republic of Belarus, the rule on distribution for serving a sentence at the place of permanent residence applies only to convicts who have been sentenced to restriction of liberty without being sent to an open correctional institution.
